Dutch Modern Migration Policy Act and the he Highly Skilled Migrant Program (interview with Marcel Reurs)

Marcel Reurs, Attorney-at-law, Partner, Everaert Advocaten, one of the oldest and largest independent Dutch immigration law firm's, talks to Connect about the Modern Migration Policy Act & its implications for India expats and highlights the opportunities for Indian businesses in the Netherlands.

Q1. Has the modern migration policy been fully implemented & how will it impact the entry of skilled workers from India into the Netherlands?

The Modern Migration Policy Act has been implemented and will take effect in less than 3 months, on June 1, 2013. It will simplify the immigration procedures for skilled expats. On the other hand, it will place additional responsibilities on employers of highly skilled migrants, in their new capacity of “authorized sponsor”. Employers will need to become fully aware of these responsibilities and must ensure their global mobility policies are compliant. Should they neglect this, then as of June 1, they will be at risk of penalties and, ultimately, having their status as authorized sponsor being revoked, which means they are banned from the Highly Skilled Migrant Program (HSMP) for a period up to 5 years. This means, that they will be disqualified from sponsoring new workers under the HSMP and from continuing the sponsoring of their current HSMP population.

Job description

How safe should donor blood be? - PhD project in public health ethics

Donated blood is screened for infectious agents to protect patients against infection. Such screening measures are effective in reducing risks to a minimum, but the quest for
safety comes at a cost. For example, the incremental cost-effectiveness of specific screening tests can be more than 1,000,000 euro/QALY, which is very high even compared to the most expensive medical treatments. How far should one go in preventing infection risks? This research project analyses this question from an ethical point of view. The project includes (a) clarification and review of the normative assumptions and arguments in current blood screening policies, (b) philosophical analysis of core concepts like precaution, safety, reasonable risk and responsibility, and (c) normative ethical analysis of obligations to maintain and promote blood safety. The study combines philosophical analysis with (focus group) interviews of stakeholders. The goal is to develop a sensible idea of obligatory and reasonable precautions against infection; and to define practical criteria for blood donor screening that are to be recommended to Sanquin.

Requirements

For this PhD research project we seek a graduated (MA level) philosopher/bioethicist with excellent skills in normative and conceptual analysis in practical ethics. The successful candidate will have a good mix of relevant skills and qualities, including:
  • curiosity and passion for studying practical philosophical problems, notably in relation to public health
  • excellence in academic writing
  • good communicative skills, notably capability to discuss ethical issues and arguments with medical professionals and policy makers
  • eagerness to work in a multidisciplinary context.
Preferably (s)he has knowledge of ethical discussions about risk and safety, and some experience with interviews and/or focus group studies.

Conditions of employment

  • salary and conditions are conform CAO Sanquin;
  • a 36-hour-week;
  • reimbursement of travel expenses;
  • a temporary appointment for a period of 1 year, if successful, will be extended to cover 4 years in total;
  • working hours are fixed by mutual agreement;
  • 8,33% year-end;
  • by full-time employment 201 vacation hours;
  • PhD training and supervision according to the regulations of the Netherlands School for Research in Philosophy (Onderzoekschool Wijsbegeerte);
  • supervision by professor Hans Zaaijer (Sanquin and University of Amsterdam, Blood-borne Infections) and dr Marcel Verweij (as of May 1st 2013: professor of
  • philosophy, Wageningen University);
  • excellent conditions for research in public health ethics: lively debate, enthusiastic colleagues with an international focus, and a fruitful work environment at the Chair Group Philosophy at Wageningen University and at Sanquin (Amsterdam);
Contract type: Temporary, 1 year, if successful, will be extended to cover 4 years in total

Organisation

Vacancy: Post-doctoral researcher on the development of physiological models of deep-sea organisms

Job NIOZ, the Royal Netherlands Institute for Sea Research - Post-doctoral researcher on the development of physiological models of deep-sea organisms

NIOZ, the Royal Netherlands Institute for Sea Research is looking for a Post-doctoral researcher (3 years) on the development of physiological models of deep-sea organisms

Specifications - (explanation)
LocationDen Burg, Texel, The Netherlands
Function typesTechnical, Laboratory positions, Postdoc positions, Research, Development, Innovation
Scientific fieldsNatural Sciences, Engineering

Job description

The human pressure on the deep sea has increased substantially in recent decades, as the fisheries and hydrocarbon industry are expanding their activities onto the continental shelf and beyond. Large-scale physical disturbance of the seafloor induced by these activities (i.e. trawling by fishing vessels and exploration drilling by the hydrocarbon industry) releases extensive sediment plumes into the water column that impacts nearby benthic communities. There is however a lack of assessment tools to determine the impacts of these plumes on deep-sea organisms.
Currently, we have two projects running in cooperation with Norwegian partners to assess the impacts of these sediment plumes on two key-groups of the deep-sea fauna, namely cold-water corals and sponges. Working in a team of scientists that has ample experience with experimentation and modeling of cold-water corals and sponges, you will develop physiological models, based on the Dynamic Energy Budget theory, to quantify the impacts of sediment deposition on these organisms.
In a first step, we will utilize existing data to develop a physiological model of cold-water corals and sponges, where the challenge is to incorporate group-specific metabolic activities and processes, like the formation of a carbonate skeleton by cold-water corals, into the model. Subsequently, data from disturbance experiments will be used to quantify the effects of sedimentation on important physiological processes, such as growth and reproduction. Experiments are conducted by scientists in Norway, but are designed in close collaboration with our modeling team to yield an optimal dataset for the model development.

Requirements

We are looking for a creative and highly motivated post-doc with an expertise in the development of physiological models, preferably Dynamic Energy Budget theory. A background and experience in linking experimental data with mathematical models is needed. Excellent communication skills are essential to optimize interaction with experimentalists and facilitate the knowledge transfer to potential end-users.

Conditions of employment

We offer a fulltime position for 3 years, a pension scheme, a yearly 8% vacation allowance, year-end bonus and flexible employment conditions. Conditions are based on the Collective Labour Agreement of Research Centers. The position will be located on Texel. Cost of relocation and help with housing is provided by NIOZ.

Job description

Cosmic particles with energies of up to 1020 eV pose a challenge as their source is a complete mystery; they are currently investigated at the international Pierre Auger Observatory, located in Argentina. The particle measurements can be strongly disturbed by thunderstorms, because the electric fields in a thunderstorm can accelerate shower particles and create ionization avalanches — but how large is the effect for a given electric field, or for a given proximity of a storm? A complementary question arises for thunderstorms, one of the most energetic and least understood processes in our atmosphere. Could cosmic-particle showers play a role in lightning inception? Which physical mechanisms are precisely at work when cosmic particle showers impact a cloud? Which particle energies make a significant impact, and is their number density sufficient?
To answer these questions, we now seek to hire 2 PhD students within the project 'Cosmic Lightning'. One student will work on the interface between observations and simulations and be based at the Kernfysisch Versneller Instituut (KVI) in Groningen, and one will mainly develop models and be based at the Centrum Wiskunde & Informatica in Amsterdam (CWI) within the group on Multiscale Dynamics.

In the observations the interplay between ultra-high-energy cosmic particles and thunderstorm activity in the atmosphere is investigated using radio-detection techniques at the major international infrastructures LOFAR and Pierre Auger Observatory. The theoretical student will join the particle shower models (roughly for particle energies of 1020 to 106 eV) available at KVI with gas discharge models (roughly for electron energies from 106 to 10-2 eV) available at CWI into one joint model and use it for estimates and predictions.

The KVI is an interfaculty institute for atomic and subatomic physics of the University of Groningen (RUG) and its staff members are employed partly by the university and partly by the NWO Foundation for Fundamental Research on Matter (FOM). CWI is the national research institute of The Netherlands for applied mathematics and computer science, directly supported by NWO. It is located at Science Park Amsterdam.

Requirements

We are looking for two highly motivated students with a strong interest in theoretical, computational, and experimental physics.
The PhD candidates are required to have a master's degree in (applied) mathematics, atmosphere-ocean science, (theoretical) physics, or a related field. Ideally, the candidate has a good knowledge of stochastics, numerical methods, (geophysical) fluid dynamics, and statistics, as well as experience with scientific programming. Candidates are expected to have an excellent command of English, and good academic writing and presentation skills.

Conditions of employment

When fulfilling a PhD position at the FOM foundation, you will get the status of junior scientist. You will have an employee status and can participate in all the employee benefits FOM offers. You will get a contract for 4 years. Your salary will be up to a maximum of 2,636 euro gross per month.The salary is supplemented with a holiday allowance of 8% and an end-of-year bonus of 8,33%. You are supposed to have a thesis finished at the end of your four year term with FOM. A training programme is part of the agreement. You and your supervisor will make up a plan for the additional education and supervising that you specifically need. At KVI, this plan can include teaching activities for up to 10% of your working time. The conditions of mployment of the FOM-foundation are laid down in the Collective Labour Agreement for Research Centres (Cao-Onderzoekinstellingen), more exclusive nformation is available at this website under Personeelsinformatie (in Dutch) or under Personnel (in English). General information about working at FOM can be found in the English part of this website under Personnel. The 'FOM job interview code' applies to this position.

Holland: 2013 Salary criteria for highly-skilled migrants

Highly-skilled migrants, key personnel and those holding a Blue Card must fulfil a salary criterion, which would be reviewed on an annual basis. On the 1st of January, 2013, the following gross annual wages will go into effect, including vacation pay:

  • Highly-skilled migrants from 30 years €52,010.-
  • Highly-skilled migrants younger than 30 years €38,141.-
  • People who graduated in the Netherlands €27,336.-
  • Corporate employees €52,010.-
  • Blue Card €60,952.-

To whom do these new rates apply?
The new rates apply to everyone who submits a request to the IND for an MVV (multiple entry clearance visa), a residence permit or a Blue Card, on or after 1 January, 2013. If an application for an MVV is submitted before that date, the wage criterion for 2012 would apply, even if the accompanying residence permit application is not submitted until after 1 January, 2013.

Do I need to adjust the salaries of our highly-skilled migrants annually according to the new wage criterion?
No

When should I apply the new wage rates?
1. When you employ a highly skilled migrant, a corporate employee or a Blue Card holder, either from another country or from the Netherlands;
2. When a corporate employee from another country is transferred;
3. At the time a residence permit is extended.

Furthermore, you should be sure that during the term of his contract, the salary of your highly-skilled migrant, corporate employee or Blue Card holder does not drop under the salary limit that applied when the request for a residence permit or the Blue Card was submitted (e.g. due to part-time work).

Which highly-skilled migrant falls into which category?
Highly-skilled migrants, 30 years or older, who are beginning employment on or after 1 January, 2013, should meet the wage criterion of €52,010.-

Highly skilled migrants, 29 years old or younger who are beginning employment on or after 1 January, 2013, should meet the wage criterion of €38,141.-

For the highly-skilled migrants who did, or will turn 30 years old during the course of their employment contract, the lower wage criterion will apply as long as they continue working for the same “employer”.
The “employer” here means: the person or legal entity with whom the employee has entered into an employment contract.
For students who graduate in the Netherlands and find employment as highly-skilled migrants within a year of completing their studies, there is an extra low wage criterion, regardless of their age. This criterion is set at €27,336.- for 2013 and will remain valid even if they change employers.

Scientific researchers and doctors in training to be specialists
Scientific researchers and doctors in training to be specialists may start employment as highly-skilled migrants but do not have to meet a wage criterion other than the general subsistence requirement from the Immigration Act. The social assistance benefits for a single person in 2013 will be €1100.89 per month (exclusive of vacation pay).

Corporate employees
When “start employment” and “employer” are mentioned above, what is also meant is: a company that receives a highly-skilled migrant within the confines of a corporate transfer and for that reason is regarded to be a sponsor by the IND.
Applicable to corporate employees who come to work in the Netherlands with a work permit (TWV) on or after 1 January 2013, there is a wage criterion of €52,010.-, which applies to the entire duration of the work permit.

Advice
If an employer does not meet the salary criterion, the Inspector from the Ministry of Social Affairs can impose a fine of €12,000.- per highly-skilled migrant, corporate employee or Blue Card holder. An employer, as a sponsor of highly-skilled migrants, is also required to report any changes in salaries to the IND.

For further information, please contact Marcel Reurs or Ted Badoux.

Job description

We seek to attract a PhD student who will be working on the project described below. You are a highly motivated candidate, ideally with a background in either the life or earth sciences, particularly in palaeontology, systematics, and/or anatomy. You are eager to join our new institute and to study the Naturalis natural history collections.
PhD project: Vertebrate palaeontology and systematics of early chondrichthyans
Chondrichthyans feature prominently in debates on the origin of jawed vertebrates, but remarkably little is known about the acquisition of their distinctive anatomical traits. The early fossil record of chondrichthyans is comprised mainly of isolated scales, teeth, and spines, while articulated skeletons are comparatively rare. The current project examines the morphology and phylogenetic relationships of three articulated chondrichthyan and chondrichthyan-like fossil fishes from the Devonian and Carboniferous periods.
The candidate will address several key questions regarding the characters of early chondrichthyans, how chondrichthyans are identified in the fossil record, and the implications for the timing and morphological evolution of both chondrichthyans and early jawed vertebrate fossils.
This project will provide training in phylogenetic techniques, as well as comparative morphological expertise, microscopic and histologic techniques, as well as potential for learning computed tomography techniques and possible fieldwork. Applications from candidates who submit their own project ideas in a related area are encouraged and will be considered.

Requirements

The successful candidate should have a Master's or Honour's bachelorate (or equivalent) degree in biology, geology, or palaeontology with experience in systematics/phylogenetics and preferably knowledge of anatomical or organismal biology. Previous experience in palaeontology preferred but not necessary. Excellent command of the English language (written and verbal) is required. He/she has a scientific and critical attitude, excellent time management and organizational skills, and the ability to work independently. The ideal candidate will be highly motivated with a demonstrated capacity for multidisciplinary research.

Conditions of employment

A contract (36 hours per week) for a period of one year, to be extended with three years after succesful first year evaluation. A salary of circa € 33.000 per year. The candidate will also be affiliated with Leiden University.The appointment must lead to the completion of a PhD thesis.
Contract type: Temporary, one year, to be extended with three years after succesful first year evaluation
