Dutch Modern Migration Policy Act and the he Highly Skilled Migrant Program (interview with Marcel Reurs)

Marcel Reurs, Attorney-at-law, Partner, Everaert Advocaten, one of the oldest and largest independent Dutch immigration law firm's, talks to Connect about the Modern Migration Policy Act & its implications for India expats and highlights the opportunities for Indian businesses in the Netherlands.

Q1. Has the modern migration policy been fully implemented & how will it impact the entry of skilled workers from India into the Netherlands?

The Modern Migration Policy Act has been implemented and will take effect in less than 3 months, on June 1, 2013. It will simplify the immigration procedures for skilled expats. On the other hand, it will place additional responsibilities on employers of highly skilled migrants, in their new capacity of “authorized sponsor”. Employers will need to become fully aware of these responsibilities and must ensure their global mobility policies are compliant. Should they neglect this, then as of June 1, they will be at risk of penalties and, ultimately, having their status as authorized sponsor being revoked, which means they are banned from the Highly Skilled Migrant Program (HSMP) for a period up to 5 years. This means, that they will be disqualified from sponsoring new workers under the HSMP and from continuing the sponsoring of their current HSMP population.
